Provision Consulting Group was honored to participate in the American Conference Institute (ACI) Conference on Legal, Regulatory, and Compliance Issues in the Cosmetics and Personal Care Industry, where our Co-CEO, Mr. Sung Kwon, was invited to speak alongside leading attorneys, regulatory professionals, corporate counsel, and industry experts.

The ACI conference is widely recognized as an important forum for professionals working across the legal, regulatory, compliance, cosmetics, and personal care sectors. The event brings together in-house counsel, regulatory affairs professionals, law firms, consultants, and industry decision-makers to discuss emerging regulatory requirements, enforcement priorities, and market-entry challenges affecting companies operating in the United States.

K-Beauty Goes West: Understanding the Regulatory Reality

Mr. Kwon participated in the session:

“K-Beauty Goes West: Legal and Regulatory Challenges of Bringing Korean Beauty to the U.S. Market.”

K-Beauty has evolved from a niche category into a major force within the global beauty industry. Korean skincare and cosmetic products are now widely available through major U.S. retailers, online marketplaces, specialty beauty stores, and direct-to-consumer channels.

However, increased market opportunity also brings increased regulatory scrutiny.

For Korean brands, success in the U.S. requires more than strong product concepts, innovative ingredients, attractive packaging, or an established sales history in Korea or other international markets.

Companies must also understand how their products will be classified, labeled, documented, imported, and marketed under U.S. requirements.

During the session, Mr. Kwon discussed several of the most common regulatory and business challenges Korean beauty companies encounter when entering the United States.


Key Regulatory and Market-Entry Challenges

One of the central topics was the importance of understanding U.S. import requirements before commercial launch.

A product that has already been successfully sold in Korea or other markets is not automatically considered compliant for sale in the United States. U.S. requirements may differ significantly depending on a product’s formulation, labeling, claims, intended use, and classification.

Sunscreen products are one clear example.

While sunscreens may be regulated as cosmetics in many markets, they are generally regulated as Over-the-Counter (OTC) drugs in the United States. This creates additional requirements involving active ingredients, Drug Facts labeling, establishment registration, drug listing, and other applicable regulatory obligations.

Similar issues may arise when cosmetic products make claims that could cause them to be viewed as drugs rather than conventional cosmetics.

For this reason, regulatory classification should be considered early in the market-entry process.


Labeling, Formulation, and Supporting Documentation

The session also addressed the importance of proper labeling and formulation review.

Product labels intended for the U.S. market must be evaluated according to applicable U.S. requirements rather than simply translated from Korean packaging.

Companies should carefully review areas such as:

  • Product identity

  • Ingredient declarations

  • Net quantity statements

  • Responsible Person information

  • Adverse event contact information

  • Product claims

  • Warning statements

  • OTC drug requirements, where applicable

Supporting documentation is equally important.

A product’s history of successful sales does not, by itself, establish regulatory compliance. Companies should be prepared to maintain appropriate technical documentation, formulation information, safety support, and other evidence that may be necessary to substantiate their products and claims.


Compliance Is Also About Building Trust

A key theme of Mr. Kwon’s presentation was that regulatory compliance should not be viewed only as an administrative requirement.

It is also part of building trust in the U.S. market.

For retailers, distributors, importers, business partners, and consumers, a company’s ability to demonstrate regulatory preparedness can directly affect its credibility.

As the U.S. beauty market becomes increasingly competitive and regulatory expectations continue to evolve, brands that establish strong compliance systems early are often better positioned to respond to retailer requests, regulatory inquiries, import issues, and future expansion opportunities.

In this sense, compliance becomes part of the company’s broader business strategy.


The Growing Importance of K-Beauty in the U.S. Regulatory Landscape

The inclusion of a dedicated K-Beauty session at a major U.S. legal and regulatory conference also reflects a larger shift in the beauty industry.

Korean beauty brands are no longer viewed simply as overseas niche brands entering the United States.

They are becoming an increasingly important part of the mainstream U.S. cosmetics and personal care market.

With that growth comes greater attention from retailers, consumers, regulators, legal professionals, and industry stakeholders.

For Korean manufacturers and brands, understanding the U.S. regulatory environment has therefore become increasingly important—not only for initial market entry, but also for sustainable long-term growth.
